Despite being surrounded by foes, Former President Donald Trump continues to fight on —and win— with his latest victory coming after a D.C. appeals court handed him a major boost in the January 6 case.

A federal appeals court ruled on Friday against Judge Tanya Chutkan’s gag order on the former president. The court placed a temporary pause on the gag order to allow more time to consider Trump’s request for a longer freeze on the gag order.

“The purpose of this administrative stay is to give the court sufficient opportunity to consider the emergency motion for a stay pending appeal and should not be construed in any way as a ruling on the merits of that motion,” the appeals court wrote in its order.

Prior to the appeals court Friday ruling, Trump had hit out at Chutkan’s gag order noting that it was unconstitutional and “will not stand.”

“I have just learned that the very Biased, Trump-Hating Judge in D.C., who should have RECUSED herself due to her blatant and open loathing of your favorite President, ME, has reimposed a GAG ORDER which will put me at a disadvantage against my prosecutorial and political opponents,” Trump wrote on Truth Social. “… but I will appeal. How can they tell the leading candidate that he, and only he, is seriously restricted from campaigning in a free and open manner? It will not stand!”

George Washington University law professor Jonathan, in a Fox News interview, said he believes the appeals court issued the temporary pause on the gag order because it was unconstitutional.

“They could have left it to continue, to continue while they reviewed it, but, they decided, perhaps in an abundance of caution to order this stoppage until they can give it a full review,” Turley said. “The reason I think this could be quite significant is because I think the order is unconstitutional.

Former chief counsel for then-Senate Judiciary Committee Chairman Sen. Chuck Grassley (R-IA) Mike Davis, however, believes that the appeals court ruling is “merely a temporary tactical retreat by the Marxists.”

“I think this is a tactical retreat by these Democrat judges. They know that Jack Smith and Tanya Chutkan’s gag order is blatantly illegal, blatantly unconstitutional. They know it’s going to get vacated by the Supreme Court and so this is a tactical retreat with this temporary stay by the DC Circuit,” Davis told Breitbart News.

Davis told Breitbart News that the D.C. Circuit will modify the gag order and make it less vague when it decides on Trump’s request.

“It’s still going to be illegal, but it’s not going to be as blatant,” he said. “I think it’s going to be more narrow and more specific because Judge Chutkan’s order is an illegal prior restraint on Trump’s first amendment free speech rights. It is both overly broad and vague. And frankly, it’s lawless.”
